Comes now the Choctaw Nation of Oklahoma, by and through its prosecutor Robert L. Rabon and moves to dismiss the writ of prohibition filed herein for the reason that follow:

Defendant's have failed to allege that the Court of Indian 0ffenses for the Chickasaw Agency has jurisdiction to issue a writ of prohibition against another Court of Indian 0ffenses much less the Court of Indian 0ffenses for the Choctaw Nation.
