IN THE UNITED STATES DISTRICT COURT
FOR THE EASTERN DISTRICT OF OKLAHOMA

DOUGLAS G. DRY,

Plaintiff,

VS.

CITY OF DURANT, ET AL,

Defendants.

Case No. CIV 97-344 B

MOTION FOR ENLARGEMENT
OF TIME TO PLEAD OR ANSWER

Comes now the defendants, Jack Jones, Douglas Keith Childers, Ben Veenstra, Ronnie Hampton, Chris Cicio and John Doe, and respectfully show to the Court:

That all of them have been served with summons in the above styled matter; that said summons allows the last of them served only twenty (20) days to answer from June 6, 1997; that the U.S. Department of justice is presently considering whether defendants are entitled to a federal defense. A determination is not likely to be made prior to the present response time. Therefore, these defendants, in the interest of justice, request that they may be treated as federal agents or officers while said determination is being made and be allowed sixty (60) days to plead or answer.

Wherefore, defendants move the Court to enlarge their answer time to sixty (60) days from June 6, 1997 or until August 5, 1997.
