WHEREAS, the Choctaw Nation has contracted with the federal government for the operation of a Tribal CFR Court under Public Law 93-638, and

WHEREAS, a Criminal Code enumerating crimes and punishment has been adopted by the Tribal Council, and

WHEREAS, the Tribe is without a Criminal Procedure Code, and

WHEREAS, it is necessary, in order for the court system to be efficient, that such a code be implemented.

BE IT ENACTED by the Tribal Council of the Choctaw Nation of Oklahoma that this Act be cited as approval for adoption of the attached Criminal Procedure Code under the conditions described herein.

CERTIFICATION

I , the undersigned as Speaker of the Tribal Council of the Choctaw Nation of Oklahoma, do hereby certify that the Tribal Council is composed of twelve (12) seats. Eight (8) members must be present to constitute a quorum. I further certify that TWELVE (12) members answered roll call and that a quorum was present at the REGULAR Session of the Tribal Council at Tuskahoma, Oklahoma on JANUARY 8 , 1994. I further certify that the foregoing Council Bill CB-50-94 was adopted at such meeting by the affirmative vote of TWELVE (12) members, ZERO (0) negative votes and ZERO (0) abstaining.
