MOTION TO EXTEND STAY OF PROCEEDINGS AND REQUEST FOR EXPEDITED RULING

Comes now the respondents, Court of Indian 0ffenses for the Choctaw Nation and James Wolfe, Magistrate, by and through their attorney of record, Robert L. Rabon and would state to the Court as follows:

1. On April 15, 1999, respondents moved this Court for an Order Staying the Proceedings herein in order to allow respondents time in which to prepare and file a Petition for Writ of Certiorari in the United States Supreme Court.

2. On April 16, 1999, this court entered an order Staying the Proceedings for sixty (60) days or until June 16, 1999.

3. On May 21, 1999, respondents filed a Petition for Writ of Certiorari in the office of the Court Clerk of the Supreme Clerk. (A copy of same is attached marked Exhibit "A").


4. Since that Court's decision on whether to grant certiorari could be dispositive of all of the issues in the present case, respondents would request that this court extend the Stay of the Proceedings entered herein until such time as the Supreme Court rules on respondents Petition for Writ of Certiorari.

5. Counsel for respondents has made several attempts to contact opposing counsel via telephone and cannot ascertain her whereabouts. As a result, the undersigned does not know whether or not petitioners object to this motion.

WHEREFORE, respondents request this Court enter an expedited ruling extending the Stay of the Proceedings entered herein until such time as the Supreme Court rules on respondents' Petition for Writ of Certiorari.
