IN THE UNITED STATES DISTRICT COURT
FOR THE EASTERN DISTRICT OF OKLAHOMA

CASE NO. CIV-97-113B

DOUGLAS G. DRY, ET AL.

PLAINTIFFS,

vs.

UNITED STATES OF AMERICA, ET AL.

DEFENDANTS.

MOTION FOR ENLARGEMENT
OF TIME TO PLEAD OR ANSWE
R

Comes now the defendants, Hoppy Denison, Bill Barrow, Mike Russell, Steven Flowers, Chris Welch, Kenneth Johnson and Blake Johnico, and respectfully shows to the Court:

That all of them have been served with summons in the above styled matter; that said summons allows the last of them served only twenty (20) days to answer from April 27, 1997; that the U.S. Department of Justice is presently considering whether defendants are entitled to a federal defense. A determination is not likely to be made prior to the present response time. Therefore, these defendants, in the interest of justice, request that they may be treated as federal agents or officers while said determination is being made and be allowed sixty (60) days to plead or answer.

Wherefore, defendants move the Court to enlarge their answer time to sixty (60) days from April 27, 1997 or until June 26, 1997.
