No. CIV 97-113-B
DOUGLAS G. DRY, et al.,
Plaintiffs,
vs.
UNITED STATES OF AMERICA, et al.,
Defendants.
COMES NOW Bruce Green, Assistant United States Attorney, and states that it is his understanding that two of the defendants in the above styled case, namely Kim Reed and Robert Lee Rabon (referred to in the complaint as Robert Rabon, Jr.), have been served and have requested representation by the Department of Justice.
The Department of Justice has not yet granted the authority of the undersigned to represent these two individuals. It is not known at this time whether such authority is forthcoming. If the authority is forthcoming, the undersigned will need an additional fifteen days to answer or until May 21, 1997. If the authority is denied, these two defendants will need the extra days to file an answer.
Since the tribal police were only recently served in this matter, it is not expected that the additional time for these defendants to answer will impede the progress of this case.
The undersigned has contact plaintiffs' counsel who has no objection to this request.
The undersigned requests the additional time without entering his appearance for these two defendants for the reasons hereinabove stated.
I hereby certify that on the 5th day of May, 1997, a true and correct copy of the foregoing Motion to Dismiss was caused to be mailed postage pre-paid to the following:
